These Terms of Service ("Terms") govern your use of Krakn and any related websites, applications, content, or services provided by Xepatech LLC ("Company", "we", "us", or "our"). Please read them carefully before using the Service.

Definitions

Acceptance of these Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the Terms, you must not access or use the Service.

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian.

Your account

Some features require an account. You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate information and to notify us promptly of any unauthorized use. Your account is personal to you: do not share your credentials or sell or transfer your account to anyone else. You may delete your account at any time from Settings within the app; deletion permanently removes your account and associated data as described in the Privacy Policy.

Your content and acceptable use

You retain ownership of the Content you create in the Service. By making Content public (such as your profile or a public portfolio), you grant us a non-exclusive, worldwide, royalty-free license to host and display that Content as part of operating the Service.

We may remove Content or suspend accounts that violate these rules. You can report another user's content or behavior from their profile in the app.

Subscriptions (Krakn Pro)

Krakn offers an optional paid subscription ("Krakn Pro") with monthly and annual plans. Subscriptions are billed through your Apple App Store or Google Play account at the price shown at the time of purchase. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your App Store or Google Play account settings; refunds are handled by Apple or Google under their respective policies.

If your subscription lapses, your data remains intact, but Pro-only features become unavailable until you resubscribe. We may change subscription pricing or what is included in Pro; changes apply prospectively and will never silently charge you a different price than the one you agreed to at purchase or renewal.

Features described as "unlimited" (such as unlimited card scans) are subject to fair personal use. We may rate-limit, throttle, or suspend automated, abusive, or extraordinary usage that degrades the Service for others or that indicates use outside of personal collection tracking.

Prices and collection values are estimates

The Service displays market price estimates for trading cards and sealed products, along with derived values such as collection totals, gains, and losses. These figures are compiled from third-party data sources, can lag or diverge from actual market conditions, and may be inaccurate or incomplete. They are provided for informational purposes only. They are not appraisals, offers to buy or sell, or financial, investment, or tax advice. You are solely responsible for any decision to buy, sell, or hold collectibles.

Intellectual property

The Service, including its design, software, and branding, is owned by the Company and protected by applicable intellectual property laws. Krakn is an independent collection tracker and is not affiliated with, endorsed by, or sponsored by the publishers of the games it supports. All trading card game names, logos, and card images are trademarks and copyrights of their respective owners, and are displayed for identification purposes only.

If you believe content available through the Service infringes your intellectual property rights, email support@xepatech.com with enough detail for us to identify and review the content, and we will respond promptly.

Third-party services

The Service may contain links to or integrations with third-party websites, applications, or services (such as marketplaces) that are not owned or controlled by the Company. We do not monitor or assume responsibility for their content, privacy practices, or terms. We encourage you to review the terms and policies of every third-party service you use.

Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms or if we are required to do so to comply with law or to protect the integrity of the Service. Upon termination, your right to use the Service ceases immediately. You may discontinue use of the Service at any time by deleting your account and removing Krakn from your Device.

Indemnification

You agree to defend, indemnify, and hold harmless the Company and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Content, your violation of these Terms, or your misuse of the Service or of any third party's rights through the Service.

Limitation of liability

Regardless of any damages you might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms shall be limited to the amount actually paid by you through the Service during the twelve (12) months prior to the event giving rise to the claim, or 100 USD if you have not made any purchase through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, consequential, or punitive damages whatsoever (including, without limitation, damages for loss of profits, loss of data or other information, business interruption, personal injury, or loss of privacy) arising out of or in any way related to the use of or inability to use the Service, third-party software or hardware used with the Service, or otherwise in connection with any provision of these Terms.

"AS IS" and "AS AVAILABLE" disclaimer

The Service is provided to you "AS IS" and "AS AVAILABLE", with all faults and defects, without warranty of any kind. To the fullest extent permitted under applicable law, the Company, on its own behalf and on behalf of its affiliates and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the foregoing, neither the Company nor any of its providers makes any representation or warranty that the Service will meet your requirements, achieve any intended results, operate without interruption, or be error-free, or that any defects will be corrected. Some jurisdictions do not allow the exclusion of certain warranties or limitations on statutory rights of a consumer; in those jurisdictions, the exclusions and limitations in this section apply to the greatest extent permitted by applicable law.

Governing law

These Terms and your use of the Service are governed by the laws of the United States and of the state in which the Company is organized, excluding conflicts of law rules. Your use of the Service may also be subject to other local, state, national, or international laws.

Dispute resolution

If you have any concern or dispute about the Service, you agree to first contact the Company at support@xepatech.com to attempt to resolve the issue informally.

For European Union (EU) users

If you are an EU consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.

United States legal compliance

You represent and warrant that (i) you are not located in a country that is subject to a United States Government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any United States Government list of prohibited or restricted parties.

Severability and waiver

If any provision of these Terms is held to be unenforceable or invalid, that provision will be modified and interpreted to accomplish its objectives to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect. The failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise that right or require that performance at any later time, nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Changes to these Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice before the new terms take effect. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, in whole or in part, you must stop using the Service.
